Terms and Conditions

Welcome to Emulsyia, operated by Statsberg Consulting Private Limited (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your access and use of the Emulsyia platform, which connects Founders/SMEs (“Founders”) with Consultancies.

By accessing or using Emulsyia, you agree to these Terms. If you do not agree, you may not use the platform.

1. Definitions

  • Platform – The Emulsyia website and related services.
  • Founders/SMEs – Individuals or businesses posting projects and requirements.
  • Consultancies – Service providers bidding on projects.
  • Commission – A 5% service fee charged by Emulsyia on the total transaction amount for confirmed projects.
  • Users – Both Founders/SMEs and Consultancies.

2. Eligibility

  • You must be at least 18 years old and legally able to enter into contracts.
  • By registering, you confirm that all information provided is accurate, complete, and up to date.

3. User Accounts

  • Separate dashboards exist for Founders and Consultancies.
  • Users must keep their login credentials secure.
  • Users are responsible for all activities under their account.

4. Platform Services

  • Founders may publish projects with requirements.
  • Consultancies may view projects and submit bids.
  • Founders may view bids and confirm a winning Consultancy.
  • Emulsyia charges a 5% commission fee on the confirmed project transaction.
  • We act only as an intermediary platform. We do not guarantee project success, consultancy performance, or payment completion.

5. Payments and Commission

  • All payments are processed via secure third-party payment gateways.
  • We do not store or process payment details (e.g., credit card numbers).
  • A 5% commission is deducted from the transaction value before payment settlement.
  • Users are responsible for any additional payment gateway charges, taxes, or regulatory fees.

6. Refunds and Cancellations

  • Refunds (if applicable) are subject to the policies of the third-party payment provider.
  • Our 5% commission fee is non-refundable, even if the project is later cancelled or disputed.
  • Disputes between Founders and Consultancies must be resolved directly between the parties.

7. User Responsibilities

Users agree to:

  • Provide accurate project and bid information.
  • Use the platform only for lawful purposes.
  • Not engage in fraud, misrepresentation, or abusive behavior.
  • Comply with applicable laws, including data protection and tax obligations.

8. Our Responsibilities and Limitations

We provide the platform “as is” and “as available”.

We are not responsible for:

  • The accuracy of project details or bids.
  • The quality or delivery of services by Consultancies.
  • The ability or willingness of Founders to pay.

We disclaim all liability arising from disputes between Founders and Consultancies.

9. Data Protection and Privacy

We collect and process personal data in accordance with:

  • GDPR/UK-GDPR (for EU/UK users)
  • India’s DPDP Act 2023 (for Indian users)
  • CCPA/CPRA (for California users)

10. Intellectual Property

  • All platform content, branding, and design belong to Statsberg Consulting Pvt. Ltd.
  • Users retain ownership of their submitted content but grant us a license to display it on the platform.

11. Suspension and Termination

We may suspend or terminate accounts if users:

  • Provide false information.
  • Violate these Terms.
  • Engage in fraudulent or illegal activities.

12. Dispute Resolution

  • Disputes between Founders and Consultancies must be handled directly.
  • We may, at our discretion, assist in communication but are not liable for resolution.

13. Governing Law and Jurisdiction

  • For Indian users: governed by Indian law.
  • For UK/EU users: governed by UK law.
  • For US users: governed by laws of the State of California.

Users agree to the jurisdiction of courts in India, unless otherwise required by mandatory local law.

14. Changes to Terms

We may update these Terms at any time. Updates will be posted on the platform, and continued use constitutes acceptance.
